What is Mediation?
Mediation is a confidential process where a neutral third party called a mediator helps individuals or organizations in conflict resolve their differences by reaching a mutually acceptable agreement or settlement.
Unalike court or arbitration if the parties do not agree the dispute remains unresolved.
Mediation allows those involved to explore the issues in greater depth and from as many perspectives as possible in order to find a solution acceptable to both parties.
How it works
-
Generally the mediator will meet separately with each party prior to the mediation
-
Relevant documents will be shared between the parties and with the mediator
-
On the day of the mediation all parties will meet together, the mediator will explain the overall process and guide parties through each step.
-
The mediator will not impose or direct a settlement or outcome, but rather support and encourage the parties to determine their own agreement.
-
If an agreement is reached it will be written down during the mediation process and signed by each party.
